Preparation of the Search Report

Patents & Utility Models

If the examination shows that the application meets the formal requirements, or once any deficiencies have been remedied or completed, the application becomes ready for search. In the meantime, the applicant is expected to file a request for search on the state of the art with the Office and pay the relevant fee within fifteen months of the filing date or, if priority has been claimed, of the priority date. If no request has been filed within this period and the period has already expired when the prescribed notification is made, the applicant must request the search on the state of the art within one month of the date of the Office's notification. If the search is not requested or the search fee is not paid, the application is deemed withdrawn. Searches on the state of the art are carried out by the European Patent Office and by the Danish, Swedish and Russian Patent Offices. For the priority application or applications on which an application filed in Türkiye is based, the Office processes search reports issued by organizations recognized as International Searching Authorities under the Patent Cooperation Treaty or by other organizations with which the Office has signed a cooperation protocol. The fee set in the Schedule of Fees for the Office's evaluation of reports issued by these organizations is paid when the report is submitted to the Office. If a report has been prepared in a foreign language other than English, a Turkish translation must be submitted together with the report.
