Patent
Brazil is a member of the Patent Cooperation Treaty (PCT). The deadline for entering the national phase via the PCT is 30 months. A simply signed power of attorney is sufficient. A patent is protected for 20 years. For applications entering via the PCT, a copy of the PCT publication and a copy of the international search report are required. A Portuguese translation of the specification documents is required. A priority document, if any, must also be submitted. If the applicant is not the inventor, this must be stated within 60 days.
Utility model
Utility model applications can be filed. The requirements are the same as for patent applications. The total term of protection for a utility model is 15 years.
