Right to Apply for a Patent

Patents & Utility Models

The right to apply for a patent belongs to the inventor or the inventor's successors and can be transferred to others.

If an invention was made jointly by more than one person, the right to apply for a patent belongs to them jointly, unless the parties have agreed otherwise.

If the same invention was made by more than one person independently of each other at the same time,
the right to apply for a patent belongs to the person who filed first or
who has a priority right over the other.

The first person to apply for a patent is deemed to hold the right to apply for a patent
until proven otherwise.
