Chile is not a member of the Madrid Protocol. Applications can be filed through a local attorney. Trademark registration takes about 9 months. A trademark may consist of words, numbers, images and combinations of these. Fifteen prints of word marks, measuring at least 5 × 5 cm and at most 20 × 20 cm, are required. A notarized power of attorney is required, and it must also be legalized by the Chilean consulate. If priority is claimed, a copy of the document legalized by the Chilean consulate is required. A single-class system applies, so a separate application must be filed for each class. The term of protection is 10 years. The trademark can be used indefinitely by renewing it every 10 years. Oppositions can be filed within 30 days of publication of the application. Third parties may bring an action for cancellation of trademarks that have not been used within 3 years. Renewal is required every 10 years.
