Trademark registration in Tanzania

Tanzania is not a member of the Madrid Protocol. Applications can be filed through a local attorney in the country. Tanzania consists of two separate countries, Tanganyika and Zanzibar. The differences between the two are set out below. A simply signed power of attorney must be submitted. A list of the classes in which the trademark will be used must be submitted. If priority is claimed, the priority document must be notarized and submitted together with an English translation. A single-class application system is used. The international Nice Classification applies. In Tanganyika, the term of protection for a trademark is 7 years. After the first 7 years, the trademark can be maintained indefinitely by renewal every 10 years. In Zanzibar, the term of protection for a trademark is 10 years. After the first 10 years, the trademark can be maintained indefinitely by renewal every 7 years. After examination, the trademark is published for 60 days in Tanganyika and 90 days in Zanzibar. During this period, third parties may take action to have the trademark cancelled. There is a 5-year use requirement from the registration date. If the trademark is not used for 5 years, third parties may file a cancellation action against it. In Tanganyika, renewal is required every 10 years. In Zanzibar, renewal is required every 7 years.
