Serbia is not a member of the Madrid Protocol. Trademark applications must be filed through a local attorney in the country. Registration is completed within 1–3 years. A simply signed power of attorney is required. 10 prints of the mark and a list of the classes in which it will be used must be provided. A logo specimen of the mark measuring 8 × 8 cm must be provided. If the mark is in color, 3 copies must be provided. If priority is claimed for the trademark application, the priority document must be submitted notarized, together with a Serbian translation. A multi-class system is used, so one trademark can be filed in several classes. An additional fee applies starting with the 4th class. The term of protection is 10 years. The trademark can be used indefinitely by renewing it every 10 years. There is no opposition system. Third parties may bring a cancellation action against trademarks that have not been used within 5 years of the date of last use. Renewal must be carried out every 10 years.
