Benin is a member of the Patent Cooperation Treaty. The deadline for entering the national phase via the PCT is 30 months. If the applicant is not from a member state of the African Intellectual Property Organization (OAPI), an attorney must be appointed in one of the member states.

Utility model protection is available. The filing requirements are the same as for patents.
