Trademark registration in Kuwait

Kuwait is not a member of the Madrid Protocol. Applications can be filed through a local attorney. A notarized and consularly legalized power of attorney is required. A photocopy of the commercial registration record is required. A notarized sworn translation of the trademark must be submitted. A single-class system is used, so a separate application must be filed for each class. The 10th edition of the Nice Classification applies. Applications cannot be filed for the whole of Class 33, for alcoholic beverages in Class 32, or for pork in Class 29. The term of protection for a trademark is 10 years. By renewing it every 10 years, the trademark can be used indefinitely. An opposition can be filed within 90 days after publication in the bulletin. There is a 5-year use requirement. If the trademark is not used for 5 years, third parties may file an action for its cancellation. Renewal is required every 10 years.
