Trademark registration in India

India is a member of the Madrid Protocol. Applications can be filed through the Madrid Protocol or directly through a local attorney. After filing, if there is no obstacle to registration, the trademark is published for 3 months. If no opposition is received during this period, the registration is completed. The registration process takes approximately 15-16 months. A simply signed power of attorney is required. If a priority document is used, it must be submitted within 2 months. A notarized English translation of the priority document must also be submitted. A list of the classes in which registration is sought must be submitted. For a three-dimensional trademark, views from at least 5 different directions and a description must be submitted. A multi-class system is used, and the Nice Classification applies. The term of protection for a trademark is 10 years. By renewing it every 10 years, the trademark can be used indefinitely. After examination, the trademark is published for 3 months, during which oppositions can be filed. There is a 5-year use requirement. If the trademark is not used for 5 years, third parties may file an action for its cancellation. Renewal is required every 10 years.
