Malaysia is not a member of the Madrid Protocol. Applications can be filed through a local attorney in the country. For trademarks that are neither refused during examination nor opposed, registration is completed within 24 months. A notarized power of attorney is required. An image of the trademark and a list of the classes applied for are required. A single-class system is used, so a separate application must be filed for each class. The 10th edition of the international Nice Classification applies. The term of protection for a trademark is 10 years. The trademark can be maintained indefinitely by renewal every 10 years. An opposition may be filed within 60 days after publication in the Official Gazette. There is a 3-year use requirement. If the trademark is not used for 3 years, third parties may file a cancellation action against it. Renewal is required every 10 years.
