Patent
Malaysia is a member of the Patent Cooperation Treaty (PCT). The deadline for entering the national phase via the PCT is 30 months. If the applicant and the inventor are different persons, a declaration explaining the relationship between them must be submitted. The full specification must be in English or Malay. If it is in another language, it must be notarized. The term of patent protection is 20 years from the filing date or 15 years from the grant date.
Utility Model
The requirements are the same as for patents. The term of utility model protection is 10 years. It can be extended twice, by 5 + 5 years, for a total of 20 years of protection. (To be verified.)
