Trademark registration in Nepal

Nepal is not a member of the Madrid Protocol. Applications can be filed through a local attorney in the country.

A power of attorney notarized and signed in the presence of two witnesses is required. If priority is claimed, the priority document must be translated into English. The list of services for which the trademark will be used must also be translated into English.

A multi-class system is used, and the international Nice Classification applies.

The term of protection for a trademark is 7 years. The trademark can be maintained indefinitely by renewal every 7 years.

After examination, the trademark is published in the Official Gazette for 3 months. An opposition may be filed during this period.

There is a 1-year use requirement. If the trademark is not used for 1 year, third parties may file a cancellation action against it.

Renewal is required every 10 years.
