Azerbaijan is a member of the Madrid Protocol, and protection can be obtained through the Madrid Protocol. Azerbaijan applies the 10th edition of the Nice International Classification of Goods and Services for the Purposes of the Registration of Marks. Formal examination takes 2–4 months, followed by an examination that can take 5–8 months. Applications not refused by the Office are published in the trademark bulletin once the registration fee has been paid. The registration process is completed within 12–18 months. A simply signed power of attorney is required, together with a specimen of the mark and the list of goods to be covered. Multi-class applications can be filed. Trademark protection lasts 10 years and can be renewed every 10 years. Within the first 5 years, third parties may bring an action for cancellation of the mark. If the applicant is Arab or Turkish, a simply signed power of attorney is sufficient. If the applicant is not Arab or Turkish, a notarized power of attorney is required.
