Indonesia is not a member of the Madrid Protocol. Applications can be filed through a local attorney. Registration of a trademark is completed in about 36 months. After filing, the application is examined during the first 9 months. If there is no obstacle to registration, the mark is then published for 3 months, during which oppositions can be filed. If no opposition is received, final registration is granted. A simply signed power of attorney is required. Twenty-four specimens of the mark, not exceeding 9 × 9 cm, must be provided. If priority is claimed, a certified copy of the priority document is required. A list of the classes for which protection is sought must be provided. A multi-class system is used, based on the international Nice Classification. However, an application may cover no more than 3 classes; to register in more than 3 classes, a new application must be filed. The term of protection is 10 years. The trademark can be used indefinitely by renewing it every 10 years. Renewal can be filed within the last 12 months of the 10th year. After examination, the mark is published for 3 months, during which oppositions can be filed against it. There is a 3-year obligation to use the mark. If the mark is not used for 3 years, third parties may bring an action for its cancellation. Renewal is required every 10 years.
