Patent
The Czech Republic is a member of the Patent Cooperation Treaty (PCT). The deadline for entering the national phase via the PCT is 31 months. To file in the Czech Republic, you must work with an attorney. If the application is filed via the PCT, 3 copies are required. Patent protection lasts 20 years. A simply signed power of attorney is sufficient. If a priority document is used, the file must be provided with English, German and French translations. If the applicant and the inventor are different persons, a document or declaration showing the right to the patent is required.
Utility model
Utility model protection is available. For a utility model application, the specification documents must be in Czech. Utility model protection lasts 4 years. It can be extended for two further periods of 3 years each, providing a total of 10 years of protection.
