Patent
Spain is a member of the Patent Cooperation Treaty (PCT). The deadline for entering the national phase via the PCT is 30 months. A simply signed power of attorney is required. The term of patent protection is 20 years. A Spanish translation of the specification is required. After examination, the application is published in the official bulletin for 2 months. If no opposition is filed during this period, the registration becomes final.
Utility Model
All requirements for a utility model application are the same as for patents. A declaration that the inventors have transferred their rights to the applicant is required. A simply signed power of attorney is required.
