Patent
Denmark is a member of the Patent Cooperation Treaty (PCT). The deadline for entering the national phase via the PCT is 31 months. The description must be translated into English or Danish. Two copies of the description, claims and abstract and 4 copies of the drawings are required. An attorney resident in the European Economic Area is required.
Utility model
Utility model applications can be filed. There are two types of utility model: a standalone utility model, and a utility model filed in addition to a patent. The filing requirements are the same as for patents. The total term of protection is 10 years. The utility model must be extended in the 3rd year until the 6th year, and in the 6th year until the 10th year.
